On approval of the Rules for conducting compulsory medical examinations

Acting order Minister of National Economy of the Republic of Kazakhstan dated February 24, 2015 No. 128. Registered with the Ministry of Justice of the Republic of Kazakhstan on April 8, 2015 No. 10634.

In accordance with Article 155 of the Code of the Republic of Kazakhstan dated September 18, 2009 “On the health of the people and the healthcare system” I ORDER:

1. Approve the attached mandatory medical examinations.

2. The Committee for the Protection of Consumer Rights of the Ministry of National Economy of the Republic of Kazakhstan shall ensure, in the manner prescribed by law:

1) state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after the state registration of this order, its submission for official publication in periodicals and in the Adilet information and legal system;

3) placement of this order on the official Internet resource of the Ministry of National Economy of the Republic of Kazakhstan.

3. Control over the implementation of this order shall be assigned to the supervising Vice-Minister of National Economy of the Republic of Kazakhstan.

4. This order comes into force after ten calendar days from the date of its first official publication.

Rules for conducting mandatory medical examinations
Chapter 1. General provisions

Footnote. The title of Chapter 1 as amended by the acting order. Minister of Health of the Republic of Kazakhstan dated 09/03/2018 (shall be enforced upon expiration of twenty-one calendar days after the day of its first official publication).

1. These Rules for conducting compulsory medical examinations (hereinafter referred to as the Rules) were developed in accordance with Article 155 of the Code of the Republic of Kazakhstan dated September 18, 2009 “On the health of the people and the healthcare system” (hereinafter referred to as the Code), determine the procedure and frequency of mandatory medical examinations. Compliance with these Rules is mandatory for legal entities and individuals, as well as healthcare entities, regardless of departmental affiliation and forms of ownership.

2. These Rules use the following basic concepts:

1) preliminary medical examinations - mandatory medical examinations that are carried out upon entry to work or study in order to determine suitability for performing duties in a profession or study, as well as to prevent general and occupational diseases;

4) personal medical record - a personal document issued to a representative of a decreed group of the population, in which the results of mandatory medical examinations are entered with a note on admission to work.

3. Mandatory medical examinations (preliminary and periodic) are carried out by medical organizations that have qualified specialists and material and technical resources to carry out the full scope of laboratory and functional studies.

4. Mandatory medical examinations of aviation personnel (persons entering training and studying at aviation training centers for training pilots, air traffic controllers serving air traffic, pilots, flight engineers (flight mechanics), navigators, air traffic controllers, flight attendants, flight operators, amateur pilots (airplane or helicopter ), ultralight aviation pilots, flight radio operators) are carried out in accordance with medical examinations in civil aviation of the Republic of Kazakhstan, approved by order of the Minister of Investment and Development of the Republic of Kazakhstan dated June 5, 2017 No. 324 (registered in the Register of State Registration of Normative Legal Acts under No. 15325) at compliance with the requirements of paragraph 13 and these Rules.

Paragraph 1. Procedure for conducting mandatory preliminary
medical examinations of workers in contact with harmful and (or)
hazardous substances and production factors

5. Medical workers of medical organizations participating in mandatory preliminary medical examinations examine the employee and refer the subject for laboratory tests.

6. The data of the mandatory preliminary medical examination are entered into the medical record of the outpatient patient in form 025/u, approved by the order of the acting. Minister of Health of the Republic of Kazakhstan dated November 23, 2010 No. 907 “On approval of forms of primary medical documentation of healthcare organizations” (registered in the register of state registration of normative legal acts of the Republic of Kazakhstan No. 6697) (hereinafter referred to as Order No. 907), with a conclusion on compliance or non-compliance the employee’s health status in relation to the work performed (industrial practice).

7. Persons who have passed a mandatory preliminary medical examination and are found fit to work with harmful production factors are issued a medical certificate in form 086/u, approved by Order No. 907.

8. The conclusion on the compliance of the health status with the requirements necessary to perform the work, including those provided for by industrial practice during the period of students’ training in educational institutions, is made by the responsible medical worker appointed by order of the head of the medical organization.

Paragraph 2. Procedure for conducting mandatory periodic
medical examinations of workers in contact with harmful and (or)
hazardous substances and production factors

10. Territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport):

1) exercise control over the completeness of coverage, quality and timeliness of mandatory medical examinations;

2) participate in summarizing the results of mandatory medical examinations of employees;

3) provide, at the request of the head of the medical organization serving the organization where the sick person works, the head of the occupational pathology center, individuals and legal entities who provided work to the sick person, a sanitary and epidemiological description of working conditions.

12. Territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport) suspend persons from work if they do not undergo a mandatory medical examination.

13. Medical organization:

1) creates, after receiving the lists of contingents subject to mandatory periodic medical examinations, agreed upon with the territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population, a commission for conducting mandatory periodic medical examinations and draws up a calendar plan, which determines the type and volume of laboratory and other studies with taking into account the specifics of existing harmful production factors, the time and timing of the work of the medical commission. If there is a shortage and absence of medical workers conducting mandatory periodic medical examinations, the necessary studies are carried out in other medical organizations licensed for the specified type of activity. The plan is agreed upon with the administration of the organization (employer);

2) approves the composition of the medical commission. The medical commission includes medical workers: therapist, surgeon, neurologist, otolaryngologist, ophthalmologist, dermatovenerologist, gynecologist, radiologist, functional diagnostics doctor, laboratory assistant, who have undergone training in professional pathology within their specialty. The chairman of the commission is an occupational pathologist who has professional retraining in occupational pathology and a specialist certificate (occupational pathologist) and is responsible for the quality of mandatory periodic medical examinations. If necessary, other specialists (dentist, cardiologist, allergist, endocrinologist, phthisiatrician, hematologist) who have undergone training in professional pathology within their specialty are also involved in the work of the medical commission. Medical workers participating in mandatory periodic medical examinations are familiarized with the characteristics of professional activities and working conditions of workers presented by the employer;

3) submits a quarterly summary report on the periodic medical examination to the territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport), in the form in accordance with these Rules;

4) summarizes the results at the end of mandatory periodic medical examinations of workers engaged in heavy work, in harmful (especially harmful) and (or) dangerous working conditions and draws up a final report in 5 copies in accordance with these Rules, submits to territorial divisions of the state body in the field of sanitary and epidemiological welfare of the population (including in transport), within 30 calendar days after the mandatory periodic medical examination. In the appendices to the act, he provides a list of names of persons for whom transfer to another job is recommended, inpatient and sanatorium treatment, dietary nutrition, and dynamic observation are indicated. After signing, the final acts are transferred for execution to the administration, the trade union committee of the organization, to the territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport) for control, to the territorial medical organizations at the location of the employer for work, one copy remains with the medical organization that conducted the mandatory periodic medical examination;

5) enters the data of the mandatory periodic medical examination into the medical record of an outpatient patient in the form 025/u, approved by Order No. 907 and on the insert sheet of medical examinations in the form in accordance with these Rules, which is attached to the medical record of the outpatient. At the same time, each medical worker who takes part in the mandatory periodic medical examination gives his or her opinion on professional suitability. The information on the professional route is entered on the insert sheet of the outpatient medical record. Upon dismissal and transfer to another organization, an outpatient medical record with data on mandatory medical examinations is transferred to the medical organization at the place of new work. Mandatory periodic medical examinations are carried out in the presence of an outpatient medical card at the place of residence or an extract from it;

6) draws up an expert opinion of a medical commission on professional suitability, taking into account medical documentation from the place of residence, regardless of the type of medical examination. At the same time, the conclusion of the medical commission is not issued to persons for whom work in harmful and (or) dangerous working conditions is contraindicated. The expert opinion is sent to the employer within three working days, with simultaneous notification of the person who is contraindicated from working with harmful production factors.

14. Employer:

1) no later than December 1, compiles a list of persons subject to mandatory medical examination in the form, in accordance with these Rules, guided by the List of harmful production factors, professions in which mandatory medical examinations are carried out, approved by order of the Minister of National Economy of the Republic of Kazakhstan dated February 28, 2015 No. 175 ( registered in the Register of State Registration of Normative Legal Acts No. 10987) with subsequent coordination with the territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport);

2) organizes, at its own expense, periodic medical examinations;

3) ensures, together with the medical organization serving the enterprise, or with the territorial medical organization at the employer’s location, the timely referral of patients for in-depth examination and treatment to occupational pathology centers for persons with occupational diseases and suspicion of them;

4) develops, together with the medical organization serving the enterprise, or with the territorial medical organization at the location of the employer, an annual action plan for the improvement of identified patients, agreed upon with the territorial division of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport) to improve working conditions.

15. Based on the results of the mandatory periodic medical examination by the medical organization servicing the enterprise, or with the territorial medical organization at the location of the employer, groups are formed, with the subsequent determination of the employee’s membership in one of the dispensary groups and the preparation of recommendations for the prevention of occupational diseases and socially significant diseases - for further observation, treatment and rehabilitation:

1) healthy workers who do not need rehabilitation;

2) practically healthy workers who have unstable functional changes in various organs and systems;

3) workers with initial forms of general diseases;

4) employees who have severe forms of general diseases, both those that are and those that are not a contraindication for continuing to work in the profession;

5) workers who have signs of exposure to harmful production factors on the body;

6) employees with signs of occupational diseases.

16. The medical organization at the location of the employer sends lists of persons from the formed dispensary observation groups to the medical organizations at the place of residence of the employees for further dispensary observation, in the absence of a medical organization serving the enterprise.

The following are subject to dispensary observation in a medical organization serving the enterprise or a medical organization at the employee’s place of residence based on the results of mandatory periodic medical examinations: practically healthy workers who have unstable functional changes in various organs and systems; workers with initial forms of common diseases; employees who have severe forms of general diseases, both those that are and those that are not a contraindication for continuing to work in the profession; and persons with occupational diseases.

17. Workers who have severe forms of general diseases, both those that are and those that are not contraindications for continuing to work in the profession, are sent for rehabilitation to medical organizations with a treatment and rehabilitation profile, after which an examination of their professional suitability is carried out. Workers recognized as fit for professional work after the stage of medical rehabilitation are subject to dispensary observation in a group of people with initial forms of general diseases.

18. Workers who have signs of exposure to harmful production factors and signs of occupational diseases are sent to a medical organization that carries out activities to establish the connection of the disease with the profession.

19. Persons with occupational diseases are registered with an occupational pathologist at a medical organization serving an industrial enterprise or at their place of residence.

20. Medical examination of workers based on the results of mandatory periodic medical examinations is carried out on the basis of the principles of staged rehabilitation, which consists of three main stages:

1) first stage: measures to prevent diseases in practically healthy workers at health centers at industrial enterprises, in sanatoriums;

2) second stage: medical rehabilitation of persons from the “risk group”: those who often and for a long time suffer from colds, persons with various functional disorders, initial forms of general diseases, preclinical signs of occupational diseases by organizing dispensary observation and regular preventive treatment in outpatient and inpatient settings with mandatory inclusion of the sanatorium-resort stage of recovery;

3) third stage: rehabilitation of patients with occupational diseases, including disabled people due to these diseases, in the conditions of a medical organization that carries out activities to establish the connection of the disease with the profession, health resorts of sanatorium-resort bases that have a license for this type of activity.

21. Control over the medical examination and medical rehabilitation of patients and workers at enterprises is assigned to regional (city) occupational pathology offices with the involvement of territorial medical organizations and medical organizations providing services to enterprises.

22. General and specific medical contraindications when determining suitability to perform professional duties are determined by the authorized body in the field of healthcare.

Chapter 3. The procedure for conducting mandatory medical examinations of decreed groups of the population

23. Mandatory medical examinations and laboratory tests are carried out by medical organizations that have a state license for the specified type of medical activity.

24. Permission to work is issued by an organization that has a license for medical activities - examination of professional suitability.

25. By order of the head of the organization carrying out mandatory medical examinations, a responsible person (general practitioner) is appointed for conducting mandatory medical examinations and permission to work.

28. Decree persons are allowed to work after receiving a mark on admission to work in their personal medical record book.

29. Personal medical records of employees are kept at the workplace.

31. If there are epidemiological indications in a specific administrative territory, the list of professions and population groups, as well as the volume and frequency of mandatory medical examinations, is supplemented by decree of the Chief State Sanitary Doctor of the relevant territory.

33. Excluded by order of the Minister of National Economy of the Republic of Kazakhstan dated November 23, 2016 (shall be enforced ten calendar days after the day of its first official publication).

34. Administrative and economic service workers: accountant, watchman, janitor, security service, technical personnel for cleaning office and administrative premises are not included in the list of the decreed population group.

On approval of the Rules for conducting compulsory medical examinations

In accordance with paragraph 4 of Article 155 of the Code of the Republic of Kazakhstan dated September 18, 2009 “On the health of the people and the healthcare system” I ORDER:

1. Approve the attached Rules for conducting mandatory medical examinations.

2. The Committee for the Protection of Consumer Rights of the Ministry of National Economy of the Republic of Kazakhstan shall ensure, in the manner prescribed by law:
1) state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after the state registration of this order, it is sent for official publication in periodicals and in the information and legal system “Adilet”;
3) placement of this order on the official Internet resource of the Ministry of National Economy of the Republic of Kazakhstan.

3. Control over the implementation of this order shall be assigned to the supervising Vice-Minister of National Economy of the Republic of Kazakhstan.

4. This order comes into force after ten calendar days from the date of its first official publication.

Rules for conducting mandatory medical examinations

1. General Provisions

1. These Rules for conducting mandatory medical examinations (hereinafter referred to as the Rules) were developed in accordance with paragraph 4 of Article 155 of the Code of the Republic of Kazakhstan dated September 18, 2009 “On the health of the people and the healthcare system” (hereinafter referred to as the Code), determine the procedure and frequency of mandatory medical examinations inspections.

3. Mandatory medical examinations (preliminary and periodic) are carried out by medical organizations that have qualified specialists and material and technical resources to carry out the full scope of laboratory and functional studies.

Compliance with these Rules is mandatory for legal entities and individuals, as well as healthcare entities, regardless of departmental affiliation and forms of ownership.

Paragraph 1. The procedure for conducting mandatory preliminary medical examinations of workers in contact with harmful and (or) dangerous substances and production factors

5. Medical workers of medical organizations participating in mandatory preliminary medical examinations examine the employee and refer the subject for laboratory tests.

6. The data of the mandatory preliminary medical examination are entered into the medical record of the outpatient patient in form 025/u, approved by the order of the acting. Minister of Health of the Republic of Kazakhstan dated November 23, 2010 No. 907 “On approval of forms of primary medical documentation of healthcare organizations” (registered in the register of state registration of normative legal acts of the Republic of Kazakhstan No. 6697) (hereinafter referred to as Order No. 907), with a conclusion on compliance or non-compliance the employee’s health status in relation to the work performed (industrial practice).

7. Persons who have passed a mandatory preliminary medical examination and are found fit to work with harmful production factors are issued a medical certificate in form 086/u, approved by Order No. 907.

8. The conclusion on the compliance of the health status with the requirements necessary to perform the work, including those provided for by industrial practice during the period of students’ training in educational institutions, is made by the responsible medical worker appointed by order of the head of the medical organization.

Paragraph 2. The procedure for conducting mandatory periodic medical examinations of workers in contact with harmful and (or) dangerous substances and production factors

9. Mandatory periodic medical examinations are carried out once a year.

10. Territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport):
1) exercise control over the completeness of coverage, quality and timeliness of mandatory medical examinations;
2) participate in summarizing the results of mandatory medical examinations of employees;
3) provide, at the request of the head of the medical organization serving the organization where the sick person works, the head of the occupational pathology center, individuals and legal entities who provided work to the sick person, a sanitary and epidemiological description of working conditions.

12. Territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport) suspend persons from work if they do not undergo a mandatory medical examination.

13. Medical organization:
1) creates, after receiving the lists of contingents subject to mandatory periodic medical examinations, agreed upon with the territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population, a commission for conducting mandatory periodic medical examinations and draws up a calendar plan, which determines the type and volume of laboratory and other studies with taking into account the specifics of existing harmful production factors, the time and timing of the work of the medical commission. If there is a shortage and absence of medical workers conducting mandatory periodic medical examinations, the necessary studies are carried out in other medical organizations licensed for the specified type of activity. The plan is agreed upon with the administration of the organization (employer);
2) approves the composition of the medical commission. The medical commission includes medical workers: therapist, surgeon, neurologist, otolaryngologist, ophthalmologist, dermatovenerologist, gynecologist, radiologist, functional diagnostics doctor, laboratory assistant, who have undergone training in professional pathology within their specialty. The chairman of the commission is an occupational pathologist who has professional retraining in occupational pathology and a specialist certificate (occupational pathologist) and is responsible for the quality of mandatory periodic medical examinations. If necessary, other specialists (dentist, cardiologist, allergist, endocrinologist, phthisiatrician, hematologist) who have undergone training in professional pathology within their specialty are also involved in the work of the medical commission. Medical workers participating in mandatory periodic medical examinations are familiarized with the characteristics of professional activities and working conditions of workers presented by the employer;
3) submits a quarterly summary report on the periodic medical examination to the territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport), in the form in accordance with Appendix 1 to these Rules;
4) summarizes the results at the end of mandatory periodic medical examinations of workers engaged in heavy work, in harmful (especially harmful) and (or) dangerous working conditions and draws up a final report in 5 copies in accordance with Appendix 2 to these Rules, provides to the territorial divisions of the state body in the field of sanitary and epidemiological welfare of the population (including in transport), within 30 calendar days after the mandatory periodic medical examination. In the appendices to the act, he provides a list of names of persons for whom transfer to another job is recommended, inpatient and sanatorium treatment, dietary nutrition, and dynamic observation are indicated. After signing, the final acts are transferred for execution to the administration, the trade union committee of the organization, to the territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport) for control, to the territorial medical organizations at the location of the employer for work, one copy remains with the medical organization that conducted the mandatory periodic medical examination;
5) enters the data of the mandatory periodic medical examination into the medical record of an outpatient patient in form 025/u, approved by Order No. 907 and on the insert sheet of medical examinations in the form in accordance with Appendix 3 to these Rules, which is attached to the medical record of the outpatient. At the same time, each medical worker who takes part in the mandatory periodic medical examination gives his or her opinion on professional suitability. The information on the professional route is entered on the insert sheet of the outpatient medical record. Upon dismissal and transfer to another organization, an outpatient medical record with data on mandatory medical examinations is transferred to the medical organization at the place of new work. Mandatory periodic medical examinations are carried out in the presence of an outpatient medical card at the place of residence or an extract from it;
6) issues a medical certificate in form 086/у, approved by Order No. 907, having passed a mandatory periodic, preliminary medical examination and found fit to work with harmful production factors. The expert opinion of the medical commission on professional suitability is drawn up taking into account medical documentation from the place of residence, regardless of the type of medical examination. In this case, the conclusion of the medical commission to persons who are contraindicated from working in harmful and (or) dangerous working conditions is not issued, but is sent to the employer within three working days, with notification of the person who is contraindicated from working with harmful production factors.

14. Employer:
1) no later than December 1, draw up a list of persons by name indicating their place of work, the severity of the work performed, harmful (especially harmful) and (or) dangerous working conditions, as well as work experience in these working conditions, with subsequent agreement with the territorial divisions of the state department authority in the field of sanitary and epidemiological welfare of the population (including transport);
2) organizes, at its own expense, periodic medical examinations;
3) ensures, together with the medical organization serving the enterprise, or with the territorial medical organization at the employer’s location, the timely referral of patients for in-depth examination and treatment to occupational pathology centers for persons with occupational diseases and suspicion of them;
4) develops, together with the medical organization serving the enterprise, or with the territorial medical organization at the location of the employer, an annual action plan for the improvement of identified patients, agreed upon with the territorial division of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport) to improve working conditions.

15. Based on the results of the mandatory periodic medical examination by the medical organization servicing the enterprise, or with the territorial medical organization at the location of the employer, groups are formed, with the subsequent determination of the employee’s membership in one of the dispensary groups and the preparation of recommendations for the prevention of occupational diseases and socially significant diseases - for further observation, treatment and rehabilitation:
1) healthy workers who do not need rehabilitation;
2) practically healthy workers who have unstable functional changes in various organs and systems;
3) workers with initial forms of general diseases;
4) employees who have severe forms of general diseases, both those that are and those that are not a contraindication for continuing to work in the profession;
5) workers who have signs of exposure to harmful production factors on the body;
6) employees with signs of occupational diseases.

16. The medical organization at the location of the employer sends lists of persons from the formed dispensary observation groups to the medical organizations at the place of residence of the employees for further dispensary observation, in the absence of a medical organization serving the enterprise.

The following are subject to dispensary observation in a medical organization serving the enterprise or a medical organization at the employee’s place of residence based on the results of mandatory periodic medical examinations: practically healthy workers who have unstable functional changes in various organs and systems; workers with initial forms of common diseases; employees who have severe forms of general diseases, both those that are and those that are not a contraindication for continuing to work in the profession; and persons with occupational diseases.

17. Workers who have severe forms of general diseases, both those that are and those that are not contraindications for continuing to work in the profession, are sent for rehabilitation to medical organizations with a treatment and rehabilitation profile, after which an examination of their professional suitability is carried out. Workers recognized as fit for professional work after the stage of medical rehabilitation are subject to dispensary observation in a group of people with initial forms of general diseases.

18. Workers who have signs of exposure to harmful production factors and signs of occupational diseases are sent to a medical organization that carries out activities to establish the connection of the disease with the profession.

19. Persons with occupational diseases are registered with an occupational pathologist at a medical organization serving an industrial enterprise or at their place of residence.

20. Medical examination of workers based on the results of mandatory periodic medical examinations is carried out on the basis of the principles of staged rehabilitation, which consists of three main stages:
1) first stage: measures to prevent diseases in practically healthy workers at health centers at industrial enterprises, in sanatoriums;
2) second stage: medical rehabilitation of persons from the “risk group”: those who often and for a long time suffer from colds, persons with various functional disorders, initial forms of general diseases, preclinical signs of occupational diseases by organizing dispensary observation and regular preventive treatment in outpatient and inpatient settings with mandatory inclusion of the sanatorium-resort stage of recovery;
3) third stage: rehabilitation of patients with occupational diseases, including disabled people due to these diseases, in the conditions of a medical organization that carries out activities to establish the connection of the disease with the profession, health resorts of sanatorium-resort bases that have a license for this type of activity.

21. Control over the medical examination and medical rehabilitation of patients and workers at enterprises is assigned to regional (city) occupational pathology offices with the involvement of territorial medical organizations and medical organizations providing services to enterprises.

22. General and specific medical contraindications when determining suitability to perform professional duties are determined by the authorized body in the field of healthcare.

3. The procedure for conducting mandatory medical examinations of decreed groups of the population

23. Mandatory medical examinations and laboratory tests are carried out by medical organizations that have a state license for the specified type of medical activity.

24. Permission to work is issued by an organization that has a license for medical activities - examination of professional suitability.

25. By order of the head of the organization carrying out mandatory medical examinations, a responsible person (general practitioner) is appointed for conducting mandatory medical examinations and permission to work.

26. The results of mandatory medical examinations and laboratory tests are reflected in a personal medical record book, the procedure for issuing, recording and maintaining which is determined by the department of the state body in the field of sanitary and epidemiological welfare of the population in accordance with paragraph 10 of Article 155 of the Code.

28. Decree persons are allowed to work after receiving a mark on admission to work in their personal medical record book.

29. Personal medical records of employees are kept at the workplace.

31. If there are epidemiological indications in a specific administrative territory, the list of professions and population groups, as well as the volume and frequency of mandatory medical examinations, is supplemented by decree of the Chief State Sanitary Doctor of the relevant territory.

32. The list of workers subject to mandatory medical examinations, as well as the frequency and volume of laboratory and functional tests of persons working at epidemiologically significant facilities is determined by Appendix 4 to these Rules.

33. Mandatory medical examinations include:
1) examination by doctors: therapist, dermatovenerologist, gynecologist;
2) laboratory tests:
— for tuberculosis (fluorographic examination of the chest - conclusion of a radiologist);
— bacteriological examination for carriage of intestinal pathogens;
— examination for the presence of helminths;
- examination for syphilis, gonorrhea;
- a swab from the throat and nose to determine the carriage of pathogenic staphylococcus.

1. Approve the attached Rules for conducting mandatory medical examinations.

2. The Committee for the Protection of Consumer Rights of the Ministry of National Economy of the Republic of Kazakhstan shall ensure, in the manner prescribed by law:

2) within ten calendar days after the state registration of this order, it is sent for official publication in periodicals and in the information and legal system “Adilet”;

3) placement of this order on the official Internet resource of the Ministry of National Economy of the Republic of Kazakhstan.

Rules for conducting mandatory medical examinations
1. General Provisions

1. These Rules for conducting mandatory medical examinations (hereinafter referred to as the Rules) were developed in accordance with paragraph 4 of Article 155 of the Code of the Republic of Kazakhstan dated September 18, 2009 “On the health of the people and the healthcare system” (hereinafter referred to as the Code), determine the procedure and frequency of mandatory medical examinations inspections. Compliance with these Rules is mandatory for legal entities and individuals, as well as healthcare entities, regardless of departmental affiliation and forms of ownership.

2. These Rules use the following basic concepts:

1) preliminary medical examinations - mandatory medical examinations that are carried out upon entry to work or study in order to determine suitability for performing duties in a profession or study, as well as to prevent general and occupational diseases;

4) personal medical record - a personal document issued to a representative of a decreed group of the population, in which the results of mandatory medical examinations are entered with a note on admission to work.

2. The procedure for conducting mandatory (preliminary and
periodic) medical examinations of workers in contact with
harmful and (or) hazardous substances and industrial
factors

3. Mandatory medical examinations (preliminary and periodic) are carried out by medical organizations that have qualified specialists and material and technical resources to carry out the full scope of laboratory and functional studies.

Compliance with these Rules is mandatory for legal entities and individuals, as well as healthcare entities, regardless of departmental affiliation and forms of ownership.

Paragraph 1. Procedure for conducting mandatory preliminary

5. Medical workers of medical organizations participating in mandatory preliminary medical examinations examine the employee and refer the subject for laboratory tests.

6. The data of the mandatory preliminary medical examination are entered into the medical record of the outpatient patient in form 025/u, approved by the order of the acting. Minister of Health of the Republic of Kazakhstan dated November 23, 2010 No. 907 “On approval of forms of primary medical documentation of healthcare organizations” (registered in the register of state registration of normative legal acts of the Republic of Kazakhstan No. 6697) (hereinafter referred to as Order No. 907), with a conclusion on compliance or non-compliance the employee’s health status in relation to the work performed (industrial practice).

7. Persons who have passed a mandatory preliminary medical examination and are found fit to work with harmful production factors are issued a medical certificate in form 086/u, approved by Order No. 907.

8. The conclusion on the compliance of the health status with the requirements necessary to perform the work, including those provided for by industrial practice during the period of students’ training in educational institutions, is made by the responsible medical worker appointed by order of the head of the medical organization.

Paragraph 2. Procedure for conducting mandatory periodic
medical examinations of workers in contact with harmful and (or)
hazardous substances and production factors

9. Mandatory periodic medical examinations are carried out once a year.

10. Territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport):

1) exercise control over the completeness of coverage, quality and timeliness of mandatory medical examinations;

2) participate in summarizing the results of mandatory medical examinations of employees;

3) provide, at the request of the head of the medical organization serving the organization where the sick person works, the head of the occupational pathology center, individuals and legal entities who provided work to the sick person, a sanitary and epidemiological description of working conditions.

12. Territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport) suspend persons from work if they do not undergo a mandatory medical examination.

13. Medical organization:

1) creates, after receiving the lists of contingents subject to mandatory periodic medical examinations, agreed upon with the territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population, a commission for conducting mandatory periodic medical examinations and draws up a calendar plan, which determines the type and volume of laboratory and other studies with taking into account the specifics of existing harmful production factors, the time and timing of the work of the medical commission. If there is a shortage and absence of medical workers conducting mandatory periodic medical examinations, the necessary studies are carried out in other medical organizations licensed for the specified type of activity. The plan is agreed upon with the administration of the organization (employer);

2) approves the composition of the medical commission. The medical commission includes medical workers: therapist, surgeon, neurologist, otolaryngologist, ophthalmologist, dermatovenerologist, gynecologist, radiologist, functional diagnostics doctor, laboratory assistant, who have undergone training in professional pathology within their specialty. The chairman of the commission is an occupational pathologist who has professional retraining in occupational pathology and a specialist certificate (occupational pathologist) and is responsible for the quality of mandatory periodic medical examinations. If necessary, other specialists (dentist, cardiologist, allergist, endocrinologist, phthisiatrician, hematologist) who have undergone training in professional pathology within their specialty are also involved in the work of the medical commission. Medical workers participating in mandatory periodic medical examinations are familiarized with the characteristics of professional activities and working conditions of workers presented by the employer;

3) submits a quarterly summary report on the periodic medical examination to the territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport), in the form in accordance with Appendix 1 to these Rules;

4) summarizes the results at the end of mandatory periodic medical examinations of workers engaged in heavy work, in harmful (especially harmful) and (or) dangerous working conditions and draws up a final report in 5 copies in accordance with Appendix 2 to these Rules, provides to the territorial divisions of the state body in the field of sanitary and epidemiological welfare of the population (including in transport), within 30 calendar days after the mandatory periodic medical examination. In the appendices to the act, he provides a list of names of persons for whom transfer to another job is recommended, inpatient and sanatorium treatment, dietary nutrition, and dynamic observation are indicated. After signing, the final acts are transferred for execution to the administration, the trade union committee of the organization, to the territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport) for control, to the territorial medical organizations at the location of the employer for work, one copy remains with the medical organization that conducted the mandatory periodic medical examination;

5) enters the data of the mandatory periodic medical examination into the medical record of an outpatient patient in form 025/u, approved by Order No. 907 and on the insert sheet of medical examinations in the form in accordance with Appendix 3 to these Rules, which is attached to the medical record of the outpatient. At the same time, each medical worker who takes part in the mandatory periodic medical examination gives his or her opinion on professional suitability. The information on the professional route is entered on the insert sheet of the outpatient medical record. Upon dismissal and transfer to another organization, an outpatient medical record with data on mandatory medical examinations is transferred to the medical organization at the place of new work. Mandatory periodic medical examinations are carried out in the presence of an outpatient medical card at the place of residence or an extract from it;

6) draws up an expert opinion of a medical commission on professional suitability, taking into account medical documentation from the place of residence, regardless of the type of medical examination. At the same time, the conclusion of the medical commission is not issued to persons for whom work in harmful and (or) dangerous working conditions is contraindicated. The expert opinion is sent to the employer within three working days, with simultaneous notification of the person who is contraindicated from working with harmful production factors.

1) no later than December 1, compiles a list of persons subject to mandatory medical examination in the form, in accordance with Appendix 3-1 to these Rules, guided by the List of harmful production factors, professions in which mandatory medical examinations are carried out, approved by order of the Minister of National Economy of the Republic of Kazakhstan dated February 28, 2015 year No. 175 (registered in the Register of State Registration of Normative Legal Acts under No. 10987) with subsequent coordination with the territorial divisions of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport);

2) organizes, at its own expense, periodic medical examinations;

3) ensures, together with the medical organization serving the enterprise, or with the territorial medical organization at the employer’s location, the timely referral of patients for in-depth examination and treatment to occupational pathology centers for persons with occupational diseases and suspicion of them;

4) develops, together with the medical organization serving the enterprise, or with the territorial medical organization at the location of the employer, an annual action plan for the improvement of identified patients, agreed upon with the territorial division of the department of the state body in the field of sanitary and epidemiological welfare of the population (including in transport) to improve working conditions.

15. Based on the results of the mandatory periodic medical examination by the medical organization servicing the enterprise, or with the territorial medical organization at the location of the employer, groups are formed, with the subsequent determination of the employee’s membership in one of the dispensary groups and the preparation of recommendations for the prevention of occupational diseases and socially significant diseases - for further observation, treatment and rehabilitation:

1) healthy workers who do not need rehabilitation;

2) practically healthy workers who have unstable functional changes in various organs and systems;

3) workers with initial forms of general diseases;

4) employees who have severe forms of general diseases, both those that are and those that are not a contraindication for continuing to work in the profession;

5) workers who have signs of exposure to harmful production factors on the body;

6) employees with signs of occupational diseases.

16. The medical organization at the location of the employer sends lists of persons from the formed dispensary observation groups to the medical organizations at the place of residence of the employees for further dispensary observation, in the absence of a medical organization serving the enterprise.

The following are subject to dispensary observation in a medical organization serving the enterprise or a medical organization at the employee’s place of residence based on the results of mandatory periodic medical examinations: practically healthy workers who have unstable functional changes in various organs and systems; workers with initial forms of common diseases; employees who have severe forms of general diseases, both those that are and those that are not a contraindication for continuing to work in the profession; and persons with occupational diseases.

17. Workers who have severe forms of general diseases, both those that are and those that are not contraindications for continuing to work in the profession, are sent for rehabilitation to medical organizations with a treatment and rehabilitation profile, after which an examination of their professional suitability is carried out. Workers recognized as fit for professional work after the stage of medical rehabilitation are subject to dispensary observation in a group of people with initial forms of general diseases.

18. Workers who have signs of exposure to harmful production factors and signs of occupational diseases are sent to a medical organization that carries out activities to establish the connection of the disease with the profession.

19. Persons with occupational diseases are registered with an occupational pathologist at a medical organization serving an industrial enterprise or at their place of residence.

20. Medical examination of workers based on the results of mandatory periodic medical examinations is carried out on the basis of the principles of staged rehabilitation, which consists of three main stages:

1) first stage: measures to prevent diseases in practically healthy workers at health centers at industrial enterprises, in sanatoriums;

2) second stage: medical rehabilitation of persons from the “risk group”: those who often and for a long time suffer from colds, persons with various functional disorders, initial forms of general diseases, preclinical signs of occupational diseases by organizing dispensary observation and regular preventive treatment in outpatient and inpatient settings with mandatory inclusion of the sanatorium-resort stage of recovery;

3) third stage: rehabilitation of patients with occupational diseases, including disabled people due to these diseases, in the conditions of a medical organization that carries out activities to establish the connection of the disease with the profession, health resorts of sanatorium-resort bases that have a license for this type of activity.

21. Control over the medical examination and medical rehabilitation of patients and workers at enterprises is assigned to regional (city) occupational pathology offices with the involvement of territorial medical organizations and medical organizations providing services to enterprises.

22. General and specific medical contraindications when determining suitability to perform professional duties are determined by the authorized body in the field of healthcare.

3. Procedure for conducting mandatory medical examinations
decreed population groups

23. Mandatory medical examinations and laboratory tests are carried out by medical organizations that have a state license for the specified type of medical activity.

24. Permission to work is issued by an organization that has a license for medical activities - examination of professional suitability.

25. By order of the head of the organization carrying out mandatory medical examinations, a responsible person (general practitioner) is appointed for conducting mandatory medical examinations and permission to work.

26. The results of mandatory medical examinations and laboratory tests are reflected in a personal medical record book, the procedure for issuing, recording and maintaining which is determined by the department of the state body in the field of sanitary and epidemiological welfare of the population in accordance with paragraph 10 of Article 155 of the Code.

28. Decree persons are allowed to work after receiving a mark on admission to work in their personal medical record book.

29. Personal medical records of employees are kept at the workplace.

31. If there are epidemiological indications in a specific administrative territory, the list of professions and population groups, as well as the volume and frequency of mandatory medical examinations, is supplemented by decree of the Chief State Sanitary Doctor of the relevant territory.

32. The list of workers subject to mandatory medical examinations, as well as the frequency and volume of laboratory and functional tests of persons working at epidemiologically significant facilities is determined by Appendix 4 to these Rules.

33. Excluded by order of the Minister of National Economy of the Republic of Kazakhstan dated November 23, 2016 No. 485 (shall be enforced ten calendar days after the day of its first official publication).

34. Administrative and economic service workers: accountant, watchman, janitor, security service, technical personnel for cleaning office and administrative premises are not included in the list of the decreed population group.
